Family Petition – Form I-130
Form I-130 is used by a U.S. citizen or lawful permanent resident to ask USCIS to recognize a qualifying family relationship. Approval of the petition is an important step, but it does not by itself grant a visa, green card, lawful status or employment authorization.

Clear, Honest Information
Who May File for Which Relatives
- U.S. citizens may petition for a spouse, children, sons or daughters, parents if the petitioner is at least 21, and siblings if the petitioner is at least 21.
- Lawful permanent residents may petition for a spouse and unmarried children or sons and daughters.
- Cousins, aunts, uncles and other extended relatives do not qualify for a direct Form I-130 petition.
Important Considerations
- The petitioner must provide evidence of the qualifying family relationship.
- Many cases also require Form I-864, Affidavit of Support, at a later stage.
- Visa availability depends on the category, priority date, country of chargeability and the Department of State Visa Bulletin.
- Processing and waiting times vary by category and case and are not a fixed range; check the current USCIS processing times.
